1) USA Landscape Photographer of the Year is an annual photographic competition (“Competition”) open to everyone except employees of USA Landscape Photographer of the Year Ltd or Light & Land Ltd, their families and relatives and anyone else involved with the organization of the Competition. Employees of sponsors and supporters who are not involved in the organization of the Competition are eligible to enter. The owners of the Competition are USA Landscape Photographer of the Year Ltd (“USALPOTY”) of Eccliffe Mill, Gillingham, Dorset SP8 5RE, United Kingdom. Photo Permits Ltd (PPL) is the sister company to USALPOTY and has rights to commercial use of photographs where VAT is applied in a transaction between USALPOTY and any publisher/ partner/sponsor/supporter of the competition where the agreement see’s VAT applied.
It is the responsibility of each entrant to ensure that they have read and abided by the Competition Rules and the submission guidelines found in the ‘Steps to Enter’ section.
2a) Entries must be of the United States of America.
b) Entries must have been taken within the five years immediately prior to the closing date.
c) Entries that have won an award (including winner, runner-up, highly commended, commended) in a major competition (including previous Competitions), or that have been entered in such a competition where the results are pending, are not eligible for entry.
d) Once entered into the Competition, identical images must not be entered into any major competition until the Competition results are announced or until the entrant is informed by USALPOTY that their entry has not reached the next stage of judging.
e) A maximum of 20 images may be submitted in any combination of award categories or all in any one category
f) USALPOTY reserves the right to decide if a competition is ‘major’ and their decision is final. If you are unsure of the eligibility of an image you are intending to enter, please email email@example.com for clarification before proceeding.
g) Images taken during the Youth Masterclass organized for the prize winner will not be eligible for entry in the following year’s competition.
3) All entries must be submitted digitally (scans from film are acceptable) and must be uploaded via www.usalpoty.com No entries will be accepted by mail. No digital files will be returned, but all low-resolution images, apart from those short-listed, will be deleted at the end of each Competition.
4) The Competition opens on July 15, 2016 and closes at Midnight PST on September 15, 2016. The image uploader will remain open for two hours after this time to allow for the completion of entries already registered. No entries or image uploads can be accepted after this time. Please make sure that you allow enough time to complete your entry. No refunds can be made for incomplete entries.
5) There are 5 Adult categories and two special awards for those aged 19 or over on September 15, 2016:

A maximum total of 20 images per entrant may be submitted across the five main categories. For example, you may enter 5 in Classic View, 5 in My USA, 5 in Environmental Value and 5 in The DPReview Special Award or you may enter 20 in Classic view. Entrants may submit the same image into more than one category, but each category entry counts as a separate image upload. (For example, if you pay for 20 entries and upload the same image into Classic View and My USA, then 2 of your 20 entry spaces have been used).
The entry fees are as follows:

$30 up to 5 images
$45 up to 20 images
If you pay for and submit five images but then decide to submit a further five images as a new transaction at a later date, you will have to pay the full ‘five image’ fee for this second transaction, rather than paying the difference between the ‘five image’ and ‘twenty image’ fees. ie. You will pay $30 + $30, rather than the ‘twenty image’ discounted fee of $45.
The overall winner, the USA Landscape Photographer of the Year, will be the person whose image is selected as the best by the judging panel from the five main adult categories and two special awards.

The entry fees are as follows:
Up to 20 images: $10.00 flat rate
The overall winner, the USA Young Landscape Photographer of the Year, will be the person whose image is selected as the best by the judging panel from the five main categories and two special awards.
Entry fees must be paid online, by credit or debit card, by the entrant’s parent or guardian. Paying for the entry will be seen as granting permission for the entry to be made.
7) Initial entry
Image files should be uploaded to the site as jpegs (72ppi) with 2000 pixels along the longest length. Please do not include watermarks, borders or signatures on your entry. When resizing your pictures, please make sure that you do not overwrite your original file. You must ensure that you upload your images the right way round. No responsibility can be taken by USALPOTY for images that are submitted backwards or incorrectly orientated. Black & white images are eligible for all categories, as are images of panoramic format.
8) File naming protocol
File names are for your reference purposes only. All images will be cross-referenced, by USALPOTY, with a unique identifying number and the judging is based on the image alone. When you upload your images, you will be asked for caption information. This will not be used for judging purposes.
9) File sizes
a) Images from digital cameras phones be submitted to Classic View, My USA, Black & White, Environmental Value, Urban and/or the special awards and must have been taken using a camera with a sufficiently high resolution to allow the image to be reproduced at A4 size or above. We recommend that you use a camera of 6 mega pixels or more.
NB Please ensure that your camera is on its highest-quality setting.
b) Images that have been scanned from transparencies or negatives are eligible for Classic View, My USA, Black & White, Environmental Value, Urban and/or the special awards. The high-resolution scan that will be required for short-listed images is recommended to be a minimum of 30mb as an uncompressed tiff file, although a high-quality jpeg is acceptable. (8 bit, Adobe RGB 1998 colour space).
10) Digital adjustments
Classic View, Black & White, Environmental Value, Urban & Special Awards:
Digital adjustments, including High Dynamic Range (HDR) imaging techniques and stitched panoramas are allowed in all categories. However, the integrity of the subject must be maintained and the physical changes to the landscape is not permitted (removing fences, moving trees, stripping the sky from another image). The organizers reserve the right to disqualify any image that they feel lacks authenticity due to over manipulation. In the case of an image being disqualified there will be no refund issued and no discussion or correspondence will be entered into.
Digital adjustments are permitted for entries submitted for the MY USA category.
Please ensure that you keep copies of submitted images. USALPOTY will take all reasonable steps to ensure the safe storage and back-up of entries within the term of the Competition, but cannot be held responsible for exceptional circumstances including Acts of God.
All entries will be assessed by a primary selection panel approved by head judge, Charlie Waite, and a shortlist will be announced following the completion of the primary selection and interim judging processes on the 24th September 2016. All those on the shortlist will be contacted by email and will then have 7 days to supply:
a) a high-resolution file
b) an extended caption
c) full technical information – camera data and details of any post production work
Entrants must additionally supply, within the 7 day period:
a) the original RAW file
b) or an untouched camera jpeg
c) or the original scan (for film). Original transparency/negative to be available on request by organisers.
Failure to produce a high resolution file of the correct size (see # 9), together with the required supporting information, within the designated time period will eliminate an entrant from the shortlist. Should an entrant be unable to supply the information by the cut-off point but contacts USALPOTY to inform them of this fact within the seven day period, USALPOTY reserves the right to grant a short additional time period to the individual based on the specific circumstances. Any such extension is at the sole discretion of USALPOTY.
The color and cropping of the high resolution file should match that of the original entry. The submitted file should not be interpolated. The captions, extended captions and technical information of successful entries will be used in Competition publicity and may be edited.
In the event of a tie at any stage of the judging process, the decision of head judge, Charlie Waite, shall be final.
All winners will be notified by email and an exhibition of some of the shortlisted entries will be held in New York at PhotoPlus Expo in October 2016 with a touring exhibition to follow. A list of the winners will be published in USA Today and on the DPReview and USALPOTY websites from November 2016.
All monetary prizes will be paid in American dollars (USD). Payments to overseas entrants will be made using the exchange rate determined by the banking system on the payment date.
Adult class (19 or over on 15th September 2016)
The entrant, who creates the entry deemed by the judges to be the single best image, taking into account all five main adult categories plus the two special award categories, will become the USA Landscape Photographer of the Year and will win:
b) a one-day Masterclass, provided by USA Landscape Photographer of the Year Ltd, with Judge, Charlie Waite in the USA. This Masterclass will take place during 2017. Details to be advised.
Each category winner will be awarded $1,000 (excluding Future Publishing and DP Review Special Awards).
Youth class (18 or under on 15th September 2016)
The entrant of 18 or under, who creates the entry deemed by the judges to be the single best image, taking into account all five main adult categories plus the two special award categories, will become the USA Young Landscape Photographer of the Year and will win.
b) a one-day Masterclass, provided by USA Landscape Photographer of the Year Ltd, with Judge, Justin Reznick in the USA. This Masterclass will take place during 2017. Details to be advised.
Each youth category winner will be awarded $500 (excluding Future Publishing and DP Review Special Awards)
Each of the 5 category winners (both Youth and Adults);
A selection of Finalist images will be showcased in an on-line gallery at USATODAY.com
a) USALPOTY reserves the right to change prizes to ones of comparable value if required by unforeseen circumstances. Any such changes will be posted on the competition website. Prizes are not transferable and no cash equivalent will be available for non-cash prizes.
b) If any winner is unable to be contacted after reasonable attempts have been made, USALOTY reserves the right to either offer the prize to a runner-up or to re-offer the prize in any future competition.
c) Additional prizes that may be supplied by sponsors and supporters are the responsibility of their supporting companies and USALPOTY is not liable for any difficulties that may arise in relation to these specific Awards.
d) It is the responsibility of entrants from outside the USA to ensure that their country of residence allows the payment of any prize money that is won. USALPOTY reserves the right to withhold payments that are prohibited by law and no alternative prize can be offered.
e) USALPOTY reserves the right to modify, cancel or terminate the Competition given unforeseen circumstances beyond its control. These may include, but are not restricted to computer viruses, technical equipment failure or the denial of third party services that may affect the integrity and fairness of the Competition. If such an event results in cancellation or termination prior to the closing date, USALPOTY will make all reasonable efforts to refund any entry fees already received.
15) Copyright and permissions
By submitting images to the Competition, each entrant confirms and warrants that:
a) they are the sole author of each entry and that it is their original work;
b) they own the copyright and any other intellectual property rights of each image;
c) they have the prior permission of those pictured in the image (or, where the image shows any persons under 18, the consent of their parent/guardian) for the usage rights required by USALPOTY and Photo Permits Ltd (PPL) in #16 and will indemnify USALPOTY and PPL against any claims made by any third parties in respect of such infringement;
d) they have not licensed or disposed of any rights in the image that would conflict with uses to be made by the Competition (see #16 ); and
e) they have received any necessary permissions from the owner(s) of buildings included in submitted images for the usage rights required by the Competition in #16 and will indemnify USALPOTY and PPL against any claims made by any third parties in respect of such infringement.
By entering the Competition, you grant USALPOTY, PPL and its sponsors and supporters a non-exclusive, irrevocable license to reproduce, enlarge, publish or exhibit, on any media, the images for any purpose connected with the Competition. This may include, but is not limited to:
a) inclusion in the Competition book – print & digital versions;
b) display at any exhibitions;
c) on a secure web browser for judging purposes;
d) on the Competition website and on the websites of sponsors and supporters;
e) for use in press, promotional and marketing materials – both print & digital;
f) on social media used by USALPOTY, PPL, its sponsors and supporters.
If an image is short-listed, the photographer is asked to supply an extended caption for that image. This caption will be subject to the terms # 15a and #16.
Entrants also agree that USALPOTY and PPL can sub-license images to the media and to the Competition’s sponsors and supporters for reproduction in connection with the Competition.Images used on merchandise commissioned by USALPOTY and PPL will be discussed individually with the photographer concerned and a separate agreement made.
Copyright of each image is retained by its respective photographer
Entrants, whose work is commended or above, agree to take part in post-Competition publicity and agree to the use of their name and likeness for this purpose without compensation.
For the purposes of this agreement, ‘USA Landscape Photographer of the Year’ and ‘Landscape Photographer of the Year’ shall be seen as interchangeable terms. For clarity, submitted images may be used to promote ‘Landscape Photographer of the Year’, in addition to ‘USA Landscape Photographer of the Year’.
17a) USALPOTY will remove any entries from the competition that it feels may breach or contravene laws of public decency or may bring the photographer, the Competition, USALPOTY or any of its sponsors into disrepute. Such entries will be deemed as void and any fees paid will not be refunded.
b) USALPOTY will remove any entries that appear to have been taken by a member of the public trespassing on the railway network as this is a criminal offence which may lead to prosecution. Such entries will be deemed as void and any fees paid will not be refunded.
18) The decision of USALPOTY on all matters relating to the competition is final and no correspondence will be entered into. Should the entries in any category fall below the standard required by USALPOTY and the judges, then USALPOTY reserves the right not to award prizes.19) All images must be uploaded, via the USALPOTY website, following the on-screen instructions. By accepting the Competition Rules and subsequently submitting your images, you have entered into an agreement with USALPOTY. Images cannot be withdrawn or amended after the close of the competition. 21) Refund policy
a) If you intend to submit twenty images and pay the fee for this, but then only submit/upload a smaller number (for example, five) then you will not be entitled to a refund.
b) If you feel you are entitled to a refund, you may request this by contacting us. We review all refund requests on a case-by-case basis and reserve the right to decline any refund for any reason.
c) If a refund is approved, it will be actioned through the payment gateway you paid through. Your refund will be credited to the card you made payment with. You will receive a full refund minus the gateway processing costs.
a) USALPOTY cannot accept liability for any loss, damage, injury or disappointment incurred as a result of participation in, or other involvement with, the Competition, to the fullest extent allowed by law.
b) Proof of electronic submission is not held as proof of receipt by USALPOTY.
c) USALPOTY cannot be held liable for any emails, sent by USALPOTY, that do not arrive due to the entrant’s email security settings, restrictions placed by their Internet service provider or any other reason.
d) USALPOTY cannot be held responsible for damage to any computers or other technical equipment relating to, or resulting from participation in the Competition or from the download of materials connected to the Competition.
e) It is the responsibility of an entrant, on receiving prize money from USALPOTY, to ensure that they meet the tax obligations of their country of residence. USALPOTY accepts no liability for any failure by an entrant in this regard.
f) You agree at all times to indemnify, defend and hold harmless USA LPOTY, its sponsors and supporters (and all of their respective parents, subsidiaries, and affiliates, and the officers, directors, employees, licensees, and agents of each (the “Indemnified Parties”) from any and all claims, damages, liabilities, costs, and expenses, including reasonable attorney fees, arising out of the authorized use by the Indemnified Parties of any of your images and/or any materials or elements you furnished as part of the Competition.
23) Personal Data
You do not need to supply personal data to view the website. However, cookies are used to let us monitor how you are using the site, as this helps us to make improvements for the future. These are not linked to any information that will allow you to be personally identified. Your IP address may also be used to examine usage trends, but again, this will not allow for any identification. You can find out more about the cookies used below.
If you decline the offer of receiving selected marketing, then your information will be used by USALPOTY as an identifier for the images entered and for payment purposes. USALPOTY may also use the information to inform you specifically by email of the launch of the next year’s competition and of any other Landscape Photographer of the Year competition.
The information you provide to us will be held on our computers and may be accessed by or given to our staff and third parties (some of whom may be located outside the European Economic Area) who act for us to process credit card payments and provide support services on our behalf. We may also pass aggregate information on the usage of our site to third parties but this will not include information that can be used to identify you.
Other than as set out above, we shall not rent, sell nor share your Personal Data to or with any person outside U.S.A. Landscape Photographer of the Year and Photo Permits Ltd, without your consent.
Although the website uses a secure and verified payment system, please remember that other methods of internet communication, such as emails and messages sent via a website, are not secure unless they are encrypted. We cannot take responsibility for any unauthorized access or loss of personal information that is beyond our control.
The web site has hyperlinks that will take you to other sites that USALPOTY feels may be of interest to you. Selecting any of these links will direct you to a site that is not related in any way to USALPOTY. No responsibility can be taken by USALPOTY for the content contained on any such site and the link does not infer a direct endorsement or recommendation of the site and/or its products/services.

24) Changes to Terms and Conditions
The information given in these terms and conditions is correct, but USALPOTY reserves the right to change any of the above without prior notice. Any such changes will be posted on the competition website. By entering the Competition, entrants will be deemed to have agreed to be bound by these terms and conditions. Any breach of these terms by an entrant will void their entry and the entrant will be liable to USALPOTY and their sponsors, supporters and licensees for damages and losses suffered as a result of the breach. If a breach has occurred, but is discovered after the award of a prize, then USALPOTY may request the return of that prize.
25) Law Governing
This Competition will be governed by English law.
